Article 1Who we are

StartAndGrow is a trade name of StartAndGrow BV (in formation), established in Bergen, the Netherlands. Registration with the Dutch Chamber of Commerce (KVK) will follow. You can reach us at info@startandgrow.nl.

Article 2Definitions

• Check: an online calculation tool on startandgrow.nl, such as the Starter Check, Sole trader or BV?, the BV check salary, the Year-End Check and What changes in 2027.
• Result: the indication you see on screen right after a check.
• Advice: the full report we email you, with your choices, our calculation and the reasoning; you can save it as PDF or print it.
• AI explanation: the plain-language explanation with your result and advice, written by an AI model based on our calculation.
• Partner: a company that can help business owners further, for example with bookkeeping, a bank account or insurance, and that is listed on startandgrow.nl.
• User or you: anyone who uses the site or a check.

Article 3When these terms apply

aThese terms apply to all use of startandgrow.nl, the checks, results, advice and the emails we send you.

bBy using a check or requesting advice you accept these terms. You can always read, save and print them via the link at the bottom of every page.

cOur privacy statement at startandgrow.nl/en/privacy also applies to what we do with your data.

dSeparate agreements apply to partners who sign up.

Article 4What a check is, and what it is not

aA check is a calculation based on your answers and the tax, contribution and business rules that apply on the date shown in your result and report. You get an indication, not a guarantee.

bA check gives automated advice based on your answers. An adviser who knows your full situation may reach a different conclusion. A check is not a decision about you and gives no advice on any specific financial product, such as insurance or a loan. We only know the answers you give; your situation may include things a check does not ask.

cYou are responsible for the accuracy and completeness of your answers. If an answer is wrong, the result is wrong too. We do not verify your answers.

dRules change. We update the checks when they do, but we do not update advice you already received. Check the date in your report and run the check again for a new year or a new situation.

eA result may include simplifications and assumptions; these are listed in your report under "What we calculated with" and "Good to know".

fYou make your own decisions. Do not act on any advice without a check by a financial adviser who knows your full situation. If you do, it is at your own risk.

gWe do our best to keep the checks accurate, complete and up to date, but cannot guarantee this. No rights can be derived from any result or advice.

Article 5AI explanation

aOur calculation engine works everything out. An AI model then puts the result into plain words. The AI does not calculate anything itself.

bThe AI only receives the amounts and choices from the check and our calculation, never your name, email address or IP address. Every AI text is labelled "AI based on our calculation and anonymised data".

cWe automatically check that every amount in the AI explanation can be found in the calculation; if not, we show our fixed text. An AI text may still phrase something awkwardly or incompletely. If the AI explanation and the calculation in your report differ, the calculation always prevails.

dData from the checks is not used to train general AI models.

Article 6Independent advice and partners

aThe advice always comes first, names no partner and is fully independent of partners. A partner has no influence on any question, calculation or result.

bOn some pages you can choose to contact a partner. Only when you click do we send the data needed for that to that one partner. You see beforehand which data is shared.

cAny agreement you then make with a partner is between you and that partner. We are not a party to it and are not responsible for what the partner does or fails to do. The partner's terms apply.

Article 7Your email address, your advice and the link

aWe only ask for your email address if you want the full advice. We use it to send you the advice and, if you separately said yes, for tips or offers. You can unsubscribe at any time with the link in every email.

bThe email contains a personal link to your advice. Anyone with the link can open it, so only share it with people who may see it, such as your accountant or partner.

cThe link works for 12 months. We then keep the advice for another 30 days and delete it. Save your report as PDF if you want to keep it longer. More about retention is in the privacy statement.

dEmails come from info@startandgrow.nl. We never ask for a password, payment or your citizen service number (BSN) by email.

Article 8Fair use

aYou use the site and the checks for your own situation or to help someone else, for example as an adviser with their consent.

bYou may not query the checks automatically or in bulk, copy the calculation rules or texts for your own product, disrupt the site or bypass its security.

cYou may always forward a check to someone you know, with the buttons below the advice. Do not send messages to people who do not want them.

dIf you do not comply with this article, we may refuse you access to the checks.

Article 9Availability

aWe want the site and checks to work at all times but cannot guarantee it. Maintenance, outages at our suppliers or on the internet, and attacks can make the site temporarily unavailable.

bWe may change, replace or discontinue a check. Advice you already received stays available via your link until the end of the retention period.

Article 10Intellectual property

aThe checks, calculation rules, texts, reports, design and the StartAndGrow name belong to StartAndGrow or to those who licensed them to us.

bYou may keep, print and share your own advice with anyone you like, for your own situation. Copying, selling or using it for your own product or for training AI systems is not allowed without our written consent.

Article 11Liability

aThe checks are free and give an indication (article 4). We are not liable for damage resulting from a decision you make based on a result or advice, unless it is caused by intent or deliberate recklessness on the part of StartAndGrow.

bWe are not liable for damage caused by incorrect or incomplete answers, by rules that change after the date of your advice, or by what a partner does or fails to do.

cTo the extent we are liable after all, liability is limited to direct damage and to a maximum of EUR 250 per event. A series of related events counts as one event.

dThese limitations do not apply in case of intent or deliberate recklessness on the part of StartAndGrow, nor to the extent the law prohibits them. If you are a consumer, you always keep your statutory rights.

eReport any damage as soon as possible and no later than 12 months after discovering it, to info@startandgrow.nl. After that your right to compensation lapses, unless the law provides a longer period.

Article 12Force majeure

We are not liable if we cannot do something because of circumstances beyond our control, such as internet or power outages, supplier outages, cyber attacks, pandemics or government measures.

Article 13Complaints and questions

aIf you have a complaint or a question, or spot an error in a check, email info@startandgrow.nl. Mention which check it concerns and, if you have it, the date of your advice.

bWe confirm your complaint within 5 working days and respond in substance within 30 days.

cWe fix any error we find in the check. We let you know if it changes your advice.

Article 14Changes

aWe may change these terms. The date at the top shows which version applies.

bA change applies from the date on the page. For advice you already have, the terms of the day you requested it apply.

cWe announce a change that is unfavourable to you at least 30 days in advance on the site and, if we have your email address, by email.

Article 15Applicable law and disputes

aDutch law applies to these terms and the use of startandgrow.nl.

bWe prefer to resolve a dispute together. If that fails, the competent court in the Netherlands decides. If you are a consumer, you may also go to the court where you live.

cIf the Dutch and English texts differ, the Dutch text prevails.
